Please Note - These Terms of Service are for the use of the Users that includes the Event Organizers, the Suppliers the Places, and the Clients.

 

DEFINITIONS:

  • Platform: Eventbuz technical infrastructure which includes Eventbuz website and mobile application.
  • B2B: business to business
  • B2C: business to client
  • Organizers: entities that sign up on the Platform to publish their events and to use the features available for Organizers.
  • Suppliers: entities and individuals that sign up on the Platform to market their services, their products, and to use the features available for Suppliers.
  • Places: entities that sign up on the Platform to market their locales, their products, and use the features available for Places.
  • Clients: entities and individuals that sign up on the platform to profit from the information displayed on the Platform and to use the features available to Clients.
  • Businesses: Organizers, Suppliers, and Places.
  • Users/User: Businesses and Clients.
  • Event: something happening in a place at a time. 
  • Profile: page created by Users that include information and photos.
  • Feature: action and/or serious of actions that deliver and/or provide information, and/or create other action and/or serious of actions that will be available for Users.

 

Terms of Service 

Thank you for using Eventbuz!

These Terms of Service (“Terms”) are a binding legal agreement between you and Eventbuz that govern your right to use the websites, applications, and other offerings from Eventbuz (collectively, the “Eventbuz Platform”).

 

Eventbuz is a B2B and B2C third party online marketplace providing the technical infrastructure where:

  • Organizers can publish, advertise for, promote, plan, manage, and operate any sort of Event, as well as use the Features available for Organizers including selling tickets and products online.
  • Suppliers can promote and advertise for their services and products and sell their products online as well as, use the Features available for Suppliers.
  • Places can promote and advertise their locales and sell their products online as well as, use the Features available for Places.

The finality purpose of Eventbuz is to provide a Platform acting as third party marketplace bringing Businesses and Clients together and merging online services with social networking. Businesses can post information and use the Features available for Businesses. Users can find and/or browse the Events calendar available on the Platform, book online tickets for Events, buy products online, and find and/or browse for information about services and destination that are presented of the said Platform.

Organizers, Suppliers and Clients (“You” or “User”) must register an account to access and use the features of Eventbuz Platform. Eventbuz does not own, control, offer or manage any event published on the Platform. Eventbuz is not acting as an agent in any capacity, except as specified in the Payment Terms of Service (“Payment Terms”)

By using or visiting Eventbuz’s website, the User expressly agrees to be bound by the Terms here mentioned and to follow these Terms under all the applicable laws and regulations that governs such Platform. Eventbuz reserves the right to change these Terms at any time and without prior notice, effective immediately upon posting the changes on the Platform. If the User violates any of these Terms, Eventbuz may terminate the Users use of the website, restrict the said User from future use of the website and/or take appropriate legal action against the User. In the latter case, if any amounts were paid by the User through Eventbuz, due to the violation of the Terms, the user is not entitled for any refund of any sort.

1. WHO WE ARE

  1.  Eventbuz is a Platform providing a technical infrastructure for a dedicated social network and for online services specifically for the event industry. Eventbuz is a third party online marketplace that addresses all entities or individuals that could be related to a certain Event and/or the event industry. Generally, the Businesses are able to create Profiles on the Platform that allow them to social network, display any information and pictures related to themselves, their events, their services, and their products in order to market, promote, and/or sell online. On the other hand, Clients are able to create Profiles in order to social network, find information, book tickets, and buy products online. This been said, a BUSINESS on the Platform can act as a Client and benefit from other services presented by other Businesses. More specifically, Organizers and Clients are able to create through their profile one or several Supplier and/or Place profiles. As well as, Organizers are able to create through their profiles one or several events well defined and use the platform features to promote, advertise for, manage and operate such events. Suppliers can promote their services and products to Users, and Places can promote their locales and products to Users.

 

Eventbuz, through its Platform, presents the following Features but not exclusively which allow:

  • Users to create profiles so that they can have a digital identity well defined for each one of them;
  • Users to use the social network of the Platform where Businesses can publish posts, and Businesses/Clients can like, comments, and share published posts on the social network of the Platform or any other social network, website, and/or any other online platform;
  • Users to create contact lists that includes people known by the Users and may include names, contact numbers and email addresses;
  • Businesses to send online notifications and invitations via the Platform, email, WhatsApp, and the third party integrated SMS service provider;
  • Organizers to design seating plan templates and use them for their events when needed;
  • Organizers to design digital ticket templates and link a template to an event in order to issue online tickets to the buyers when needed;
  • Organizers to design digital badges templates and link a template to an event in order to issue online badges to the attendees when needed;
  • Organizers to design registration forms and link a form to an event or any other activity that needs such forms;
  • Organizers to manage the admissions of events by admitting a ticket holder to the venue and create admission reports;
  • Businesses to sell products on the E-shop of the Platform and Users to buy these products;
  • Businesses to manage tasks and inventories;
  • Users to buy online tickets;
  • Organizers to assign ticketing distributors that can sell tickets online on behalf of the Organizers for their Events;
  • Organizers to publish and sell online reduced priced tickets for an Events at the convenience of the Organizers;
  • Users to conduct statistics and market researches in order to display data collected by the Platform through the activities of Users;
  • Users to use the hot zone map view which shows the popularities of events, venues and places;
  • Businesses to use the task and inventory management Features;
  • Users can explore the hot zones on map view to see the popularities of Places and Events;

The above-mentioned services, such as tickets, are sold through Eventbuz’s Platform where Users can search, select and buy tickets online for Events. Any Eventbuz account is a secure portal where Organizers can add or modify event listings and ticket allocations, record details of cash, checks and complimentary bookings, export ticket buyer’s details, view tickets sales reports and much more services.

Features mentioned above will be added by Eventbuz to the platform when found suitable. Eventbuz has the right to add and remove any feature without any prior notice. Users on the platform don’t have any rights for any sort of claim due to adding and/or removing any Feature.

 

2. PERMITTED USES OF THE SITE

2.0 Users agree that they are authorized to visit, link to and share pages of the website and application on their social networks and websites or retain a copy of pages of the Platform for their organization’s use and that Users shall not duplicate, download, publish, modify or otherwise distribute the material on this Platform for any purpose other than to create and manage events and promotional information, for personal use, to get related information, to buy a defined product, and/or to administrate the sale of tickets from the side of an organizer or accommodator, etc., In addition, Organizers have the ability to assign ticketing distributors and to share with the latter a link which permit those distributors to sell tickets on behalf of the said Organizers.

The content and the technical infrastructure of this Platform is the property of Eventbuz and are protected by International copyright laws. All relevant legal notices and credits will be posted on the Platform. Users are not permitted to remove any such notices or credits, or any additional information presented in respect of copyright.

Every User has the right to share the website or any page desired from the Platform on their personal accounts of social media, private conversations and groups, limited to the norm and regulations of data protection known internationally. Every sharing should be objective and should copy the original idea presented by the platform without any circulation or changes of facts and meanings whatsoever.

 

2.1 Users Contributions to the Site

The Platform provides the Users with opportunities to contribute to the Platform by uploading information about themselves, their companies, their businesses, their events, their services, and their locales, known as "User content".

Eventbuz is not liable or responsible for any User content. The contributions of third parties do not necessarily represent the view or opinions of Eventbuz.

Eventbuz cannot preview user content before it appears.

 

2.2 Prohibited Content

Users can be held liable for any illegal or prohibited content they provide to the Platform. Prohibited content includes, but is not limited to content that:

 

  • Is offensive such as content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
  • Could be harmful to minors;
  • Harasses or advocates harassment of another person;
  • Involves the transmission of "junk mail", "chain letters", or unsolicited mass mailing or "spamming";
  • Promotes information that you know if false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
  • Promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
  • Contains restricted or password only access pages; or hidden pages or images (those not linked to from another accessible page);
  • Displays pornographic or sexually explicit material of any kind;
  • Provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18;
  • Provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
  • Solicits passwords or personal identifying information for commercial or unlawful purposes from other users; and
  • Engages in commercial activities and / or sales such as gambling; lotteries; bidding fee auctions; sports forecasting or odds making; fantasy sports leagues with cash prizes; internet gaming; contests; sweepstakes; games of chance.

 

If Users come across or discover this kind of material on the platform, please notify us by emailing us at Support@eventbuz.com and we will investigate the claim and may then take appropriate action.

Every action will be judged based on the international norms and regulations in a general way, and, in a specific manner, based on the governing laws and restrictions of the country the users is originated or connected from.

 

2.3 Offline Conduct

Although Eventbuz cannot monitor the conduct of all the Users on the platform, it is also a violation of these rules to use any information obtained from this Platform in order to harass, abuse, or harm another person, or in order to contact, advertise, to solicit or sell to any site user without their prior explicit consent.

Eventbuz also retains the right to suspend or terminate any User’s access to the website if the conduct of a business or clients using the Eventbuz services, leads to damage to reputation by association.

 

2.4 Links and Search Results

The Platform contains embedded links to, and may produce search results that reference or link to third party sites throughout the World Wide Web (for example redirecting a client buying a ticket to the platform that sell the ticketing). Eventbuz has no control over these sites or the content within the site. Eventbuz cannot guarantee, represent or warrant that the content contained in the sites is accurate, legal and/or inoffensive and will not contain viruses or otherwise impact your computer.

By using the Platform to search for or link to another site, you agree and understand that you may not make any claim against Eventbuz for any damages or losses, whatsoever, resulting from such action.

 

2.5 Access and Interference and Multiple Browser Windows

 

Users agree that they will not use a robot, spider, other automatic device or manual process to monitor or copy our web pages or the content contained therein or for any other authorized purpose, without our prior expressed written permission. Users agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of the website.

Users agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure. Users agree that you will not access, reload or "refresh" transactional event or ticketing pages, or make any other request to transactional servers, more than once during any three second interval.

When using the Platform, Users have to ensure they are using only one browser window. Using multiple browser windows could result in duplicate listings (if Users are using the website as an Organizer who is creating an Event per example).

No one could or should create a profile on behalf of a Business or use their names or information unless they have consent from the Business to do so.

 

2.6 Unauthorized Use of the Platform

Illegal and / or unauthorized use of the site, including, but not limited to, unauthorized ticket and items sales, fraudulent listings of Events, products or any service presented by the platform, by individuals or organizations other than the legitimate Users; unauthorized framing of or linking to the site, or unauthorized use of any robot, spider or other automated devices on the platform, will be investigated and appropriate legal action will be taken, including without limitation, civil, criminal and injunctive redress.

The above-mentioned includes the creation of fake accounts, fake Profiles, spam accounts or posts, as well as, displaying any misleading information in any Profile or page created on the platform, or sending directly or indirectly any communication or message via the Platform.

Any activity that could deviate the original idea from the concept of the Platform can be considered as fraudulent activity.

 

2.7 Violation of the Terms

Users understand and agree that in Eventbuz 's sole discretion, and without prior notice, Eventbuz may terminate their access to the platform, cancel ticket orders or products or services or exercise any other remedy available and remove any unauthorized user content, if Eventbuz believes that the Users conduct, or the content Users provide, violates or is inconsistent with these Terms, or violates the law or the rights of Eventbuz, a client of Eventbuz or another user of the platform.

Users agree that monetary damages may not provide sufficient remedy to Eventbuz for violations of these Terms and you consent to injunctive or other equitable relief for such violations. Eventbuz is not required to provide any refund to Users if the latter are terminated as a User because they have violated these Terms or any of Eventbuz 's rights.

The Violation of these terms and conditions or any resultant contract, at any time, shall be grounds for action by Eventbuz which have the right file a lawsuit for damages or any demands based on any legal basis applicable to the relevant matter, and in front of any competent court and in accordance to the law that Eventbuz and the said court find the most suitable.

 

3.0 REGISTRATION & ACCOUNT SECURITY

You must be 18 or over to sign up for a Eventbuz account as a User especially if you desire to buy and/or reserve tickets for an Event and/or a product, and/or benefit from any services presented of the Platform.

Users agree to maintain and promptly update their registration details to keep it accurate and current. If Users provide any information that is untrue, inaccurate, not current or incomplete, or Eventbuz has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Eventbuz has the right to suspend or terminate all of their accounts and refuse any and all of their current or future use of Eventbuz.

If Organizer, Supplier or a Place do not renew the registration Eventbuz is not responsible of any losses of any kind due to the deactivation of the profile including ticket sale and item sales, promotion of events or services (financial, and/or any other direst or indirect loss).

All Profiles have a limited time of use. Every account should be renewed in compliance to the conditions of renewal mentioned on the Platform. Eventbuz is not responsible for any losses of any kind due to the deactivation of their profile (ticket sale, promotions, services...).

During the Eventbuz registration process, a unique account and password will be created. It is the responsibility of Users to maintain the confidentiality of the password and account and they are fully responsible for all activities that occur under the said accounts, including without limitation, all actions by sub-users registered under their accounts. The Users must immediately notify Eventbuz of any unauthorized use of your password or account or any breach of security. Eventbuz cannot and will not be liable for any loss, damage or other liability arising from Users’ failure to comply with this section or from any unauthorized access to or use of your account.

The registration process of an Organizes on the Platform includes submitting the registration form to Eventbuz for approval prior to becoming an active User on the Platform. Eventbuz has the right to reject any registration request submitted by any Organizer without any explanation if the submitted form was not approved by Eventbuz.

If an account has not had any log-in access for three years, or if a new Eventbuz account is created but no activities whatsoever is not done within six months, it will be considered a dormant account and all data will be cleared. Account owner has no right for any complain and/or any claim due to clearing his data from the Platform.

 

4.0 PAYMENT PROCESSING

 

4.1 Overview

There are three types of payment processing options available to Businesses subscriptions when using the Eventbuz system:

  • Online credit and debit card payments.
  • PayPal payments
  • Bank transfer. In case of bank transfer payment, Accounts will not be activated prior successful payment and receiving the registration fee to Eventbuz account and the activation of an account is conditioned by the successful payment of the registration fees for using the Platform.

 

As for online ticketing online debit and credit cards payments option is available for users when booking an online ticket using Eventbuz system.

 

  • Eventbuz payment processing: Credit/debit cards bookings processed online via the Platform integrated merchant services gateway.
  • Income generated from online ticketing is held in a trust account and will be transferred by the trust account to Eventbuz bank account one week after the conclusion of the Event. Eventbuz will transfer to the Event Organizer his share of the ticket sales within one week after receiving the money released by the trust bank to Eventbuz account.
  • Income generated from the E-shop is held in the trust account and will be released to Eventbuz bank account one week after delivery of the products sold on the E-shop.
  • Eventbuz will transfer to Organizers, Suppliers, and Places their shares of the products sales within one week after receiving the money released by the trust bank to Eventbuz account.
  • Income generated from Organizers, Suppliers, and Places registration fee, is held in the trust account and will be released to Eventbuz bank account one week after the end of the subscription end.
  • Income is thereafter deposited to the Event Organizer’s bank account less the applicable booking fee and delivery fee, telephone service fee (where applicable). See section 4.3.

Eventbuz has the right to add or remove any payment method to Businesses subscriptions and/or online ticketing and/or any of the above listed conditions at any time without prior notice. Changes will be applicable for all new subscriptions and online ticketing from the date of publishing the revised on the Platform.

 

4.2 Eventbuz payment processing

 

Businesses do not need their own payment gateway to utilize the Platform payment processing option. Bookings placed online will be processed by the Eventbuz integrated payment gateway. Incomes generated from the online ticketing sales and the E-shop will be held in the trust bank account and will be released to Eventbuz bank account seven days after the conclusion of the event, or the successful delivery of the products sold online. Income less applicable fees will be transferred to the Event Organizer, Suppliers and Places bank accounts within seven working days after receiving the money, released by the trust account, to Eventbuz account. For booking fees, go to section 5.1. As for the Eshop, income will be transferred after successful delivery of the item to the buyer.

Businesses are not permitted to obtain customer credit/debit card details and process the order themselves via Eventbuz public sales pages (online bookings). Handling customer card details and using the Platform Merchant Services for in-house bookings is in breach of these terms and conditions. If an Event Organizer would like to accept credit/debit cards as a payment type for in-house bookings, the Event Organizer will be required to secure their own merchant services or utilize the Stripe payment processing option.

 

4.2.1 Collection of Monies

 

You authorize Eventbuz to accept Visa, MasterCard, American Express, Discover, Diners Club International and Union Pay cards and to collect the face price of each ticket, and Eshop items, and also, where you have opted for the booking fee to be billed to the Clients, we will collect a booking fee from each Client and where applicable, a telephone service fee or delivery fees if requested. We will retain the full amount of the booking fee (whether paid for by the Event Organizer or the Client), telephone service fee and delivery fees.

The proceeds of all credit and debit card sales transacted via Eventbuz are paid into a segregated "Client" bank account meaning that they are completely ring-fenced from our own working capital. These arrangements are in line with best practice as specified by all major credit card companies and also by STAR (the Society of Ticket Agents and Retailers).

 

4.2.2 Transfer of Funds 


Once the event or event run has concluded, the online sales for that event will then be totaled and prepared for transfer to the event organizer bank account.  Event organizer will receive an email the Monday following the event requesting that they confirm their event went ahead by responding to the email. Once verified, and after receiving the income from the trusted bank, your ticket settlement will be processed net of Eventbuz Fees as stated in 5.1 and any refunds to be made to Customers as a result of cancellation.  Eventbuz will undertake ticket settlement transfers on a Monday and Thursday afternoon with ticket monies deposited into your account within seven working days after receiving the monies from the trust bank account.
If any Event or series of Events are cancelled or postponed, Eventbuz will refund the customers directly and shall be entitled to utilize sufficient funds from the ticket proceeds referred to above to enable Eventbuz to do this. Notification of cancellation may delay the transfer of funds while confirmation and clarification is sought.
All money shall be paid into the bank account specified in your payment details. It is not the responsibility of Eventbuz to verify bank details but is the responsibility of the Event Organizer to ensure that accurate bank details are provided. Eventbuz will not accept any responsibility if the Event Organizer or any authorized person assigned by the Organizer has provided incorrect bank details and monies owed are paid into the wrong bank account.

 

4.2.3 Prior Acquisition of Funds

You, as the Event Organizer, cannot withdraw funds from your account until the event has been completed. If funds are received prior to an event having been completed, Eventbuz will have every right to seek reimbursement for any refunds and administrative charges that may arise if the event were to be cancelled. Where an agreement for reimbursement cannot be reached, Eventbuz will be entitled to take legal action against the Event Organizer and the account will be suspended.

 

4.2.4 Chargebacks

A chargeback occurs when a User disputes a charge on their credit/debit card with our merchant services provider. When a chargeback occurs the merchant services provider will investigate as to whether the charge is to stand or be refunded to the customer.

Eventbuz will provide all requested information and documentation to the merchant services provider during the investigation.  When a chargeback is received, Eventbuz has the right to deduct the disputed amount and any fines levied by the merchant services from an Event Organizer’s future ticket settlement.  Should the chargeback be cancelled by the User or the case won by Eventbuz, any amounts withheld from settlements will be returned to the Event Organizer.  Failure by the Event Organizer to pay the chargeback may result in the account being suspended.

Any tickets that are subject to a successful chargeback dispute will be cancelled.

 

4.3 Integrated payment gateway payment processing

The booking income will go to trust bank account and will be transferred by the trust account to Eventbuz bank account one week after the completion of the Event. Eventbuz will do the payment to the Organizer’s bank account within one week after receiving the money by Eventbuz.

The Businesses agree to:

 

  1. All online payments will be processed by the Platform’s integrated payment gateway.
  2. The deduction of booking fees, E-shop fee, and ticket/product delivery fees or telephone box office fees (where applicable) prior to income being transferred to Business bank account.
  3. Accept responsibility for refunds. Please note that booking fees are only refundable if an event is cancelled or significantly altered as further detailed in these Terms.
  4. Notify Eventbuz of any event cancellation or significant changes to an Event (e.g. change of date, venue, headline act). In this situation, Eventbuz will process refunds- when applicable and as further detailed in these Terms- for customers to ensure the booking is refunded (including booking fee but excluding ticket delivery fees/telephone service fees/refund protection if outside of 14 day cooling off period). Booking fees will not be refunded if the cancellation or notification procedure is not followed.
  5. Accept responsibility for chargebacks.
  6. Accept responsibility for compliance with PCI DSS standards and data protection and the safe handling of payment cards and confidential information.
  7. Indemnify Eventbuz against any customer claims relating to refunds, errors or failure to refund, chargebacks or double charges.

 

For booking fees, see section 5.1.

 

4.4 VAT Liability

Businesses that are selling products on the Platform remain solely responsible for the accounting and payment of VAT collected through the sale of those products to HM Revenue and Customs. Eventbuz is only liable for the VAT component of the selling fee. At the conclusion of your event, you will be provided with a full income breakdown for your selling monies received from online sales, which will include details of the Users VAT liability (if applicable).

 

4.5 Tickets Sales Management

The ticket sales management offered by Eventbuz is made available without charge for Organizers and their administrative representatives to keep track of all ticket sales whether through:

- Eventbuz’s (known as online sales), or direct to the Event Organizer (known as offline sales);

- Displaying as their credentials and/or third party’s credentials (an outsider distributor) in order so that Users can contact them and book directly;

- A link (URL) that redirects the Users to another platform that is selling the tickets.

To avoid double booking, if an Organizer is selling tickets online on Eventbuz, the Organizer is not allowed to sell the same tickets offline. If an Organizer sells offline tickets while selling on Eventbuz, the latter will not be responsible for any double booking. Eventbuz will not be liable for any such discrepancy or its consequence. It is the responsibility of the Organizer to avoid double booking by not selling offline any tickets posted on the Platform for online sales. If Organizer wants to sell tickets offline while selling on Eventbuz, he should post on Eventbuz only the tickets that he wants to sell on the Platform and he is not allowed to sell them offline unless he un-post them from the Platform.

An Organizer can block seats prior posting the event online. The seats will be marked as sold and will not be available for online sale. Seats can be made available for sale after publishing the event if the Organizer wishes to release them and sell them online.

If Organizer diverted the traffic via URL, Eventbuz does not keep any record for ticket sold since the booking is done via different platform. In that case, the Organizer or the other platform selling the tickets are solely responsible of updating the available seats.

If the Organizer uses the Platform’s sales management Feature and assigns one or more ticketing distributor to sell tickets on his behalf, it is the Organizer full responsibility to ensure that the same seat is not assigned to more than one distributor to avoid double booking. Eventbuz is not responsible for any double booking related to any data entry mistakes done by the Organizer and or any claim or refund fee which may occur.

If Event Organizer is selling ticket on Eventbuz Platform he should make sure that the number of seats or reservation posted online are not more than the capacity of the venue and/or the capacity mentioned in the authority permit for the Event. Eventbuz is not responsible for overselling seats and/or tickets and overselling tickets and seats remains the Organizer full responsibility.

 

5 FEES AND CHARGES

 

  1. Subscription Fees
  2. Eventbuz has the right to change the subscription fees at any time without the need for a  prior notice.
  3. Subscription fees will be held in the trust bank account and will be released to Eventbuz bank account one week after the end of the subscription.
  4. Subscription fees are not refundable.
  5. Subscription fees are the sole right of Eventbuz.

 

  1. Ticketing booking Fees
  2.  Eventbuz fee is 7.5% unless there is a written agreement between the Organizer and Eventbuz. In case such agreement exits, percentage stated in the agreement will be applicable.
  3. E-shop Fees.

 

  1. Eventbuz fee is 7.5% unless there is a written agreement between the Organizer and Eventbuz. In case such agreement exits, percentage stated in the agreement will be applicable.

 

  1. Products Delivery Fees

All tickets that are sold online on Eventbuz Platform, will be delivered as Etickets by email and on the Platform.

As for the products sold on the E-shop of the Platform, delivery fee will be added to the price of the items sold. Users will pay the price of the items they wish to purchase online including the delivery fee which will be provided by the platform and added to the total due amount to be checked and confirmed by the Users prior processing the online payment. 

Eventbuz has the right to do any promotion at any time that may be applicable for a period of time and/or to some countries. Promotion will not be applicable to subscriptions done prior the promotion. Subscribers do not have the right to claim any refund.

 

6. EVENT LISTING PROCESSES AND RESPONSIBILITIES

 

6.1 Through use of the Platform, Users upload data regarding their organization, products, venues, event dates, event time, event location, ticket prices, preferred fee charging mechanism, etc. This data populates Eventbuz sales website from which the customer can then purchase different products for the listed events and products.

All details of Events or products including, but not limited to, performance times, ticket prices, seat availability, products, addresses, contacts, location, descriptions, images, specifications, and/or any information for an Event or product that is promoted on the platform, are entered onto the system by Users.  The accuracy of all such information is at all times the responsibility of the User entering those details. Failure to provide accurate details (including amendments to an event if the date or time changes, etc.) will breach this agreement and may lead to the account being suspended and Eventbuz will be entitled to seek compensation for any direct costs incurred as a result of incorrect event information listed on Eventbuz.

The Businesses are responsible for the creation and distribution of automatic discounts and discount codes. The Businesses must test their products sales to ensure that discount codes and automatic discounts have been set up correctly to provide the correct discount for the applicable event(s), product price(s) and validity period. Eventbuz will not be held responsible for discount codes or automatic discounts that have been set up incorrectly.

Organizer can sell reduced priced tickets on Eventbuz if the option is available to the Organizer subscription level. The Organizer can select the seats and the discount percentage and publish the reduced priced ticket campaign on the platform by sending notifications to Users. If Organizer is using the reduced priced ticket Feature, it is Organizer responsibility to ensure that the number of seats, the type of seats, and the price reduction are correct. Eventbuz will not be responsible of any loss or any consequences due to mistake in the data entry done by the Organizer.

 

6.2 Copyright Policy

We will terminate the privileges of any User who uses the Platform to unlawfully transmit copyrighted material without a license of express content, valid defense or fair use exemption to do so. In particular, users who submit user content to the website, whether articles, images, stories, software of other copyrightable material must ensure that the user content they upload does not infringe the copyrights or other rights of third parties (including, but not limited, to trademark, trade secret, privacy or publicity rights). After proper notification by the copyright holder or its agent to us, and confirmation through court order or admission by the User that they have used this website as an instrument of unlawful infringement, we will terminate the infringing Users' rights to use and / or access to this platform.

We may, also in our sole discretion, decide to terminate a User's rights to use or access to the website prior to that time if we believe that an alleged infringement has occurred.

 

6.3 Event Specific Terms and Conditions

Tickets are issued subject to the Eventbuz terms and conditions and the refund policy stated in the Eventbuz Customer Purchase Policy will supersede an Event Organizer’s own terms and conditions when using Eventbuz merchant services to process ticket sales. However, each individual Event or Venue may include their own Terms and Conditions (if applicable) including age restrictions, discretionary refunds, and exchange policies, etc. If an Event or Venue has its own Terms and Conditions, they must be included by the Organizer of the Event within the booking process while creating the Event’s profile.

 

6.4 Pricing Errors

If the amount paid by the Customer for a product sold through Eventbuz is grossly incorrect, regardless of whether because of an error in a price posted on the Platform or otherwise communicated to the Users and regardless of whether caused by transactional malfunction of this platform or other Eventbuz operated system or by human error on the part of any User, then Eventbuz will have the right to cancel that order and refund the Users the amount that they paid.

 

7. Order Confirmation

Order confirmation will take the form of a summary web page at the end of the purchase sequence. This will be followed by an email and notification on the application dispatched to Users. Both contain details of the ticket or products purchased and a unique purchase reference number, which acts as the User’s proof of payment

If a User does not receive a confirmation number (in the form of a confirmation page or email) after submitting payment information, it is their responsibility to confirm with our Customer Service Department whether or not the order has been completed, as only the User may be aware of any problems that may occur during the purchase process. Eventbuz will not be responsible for losses (monetary or otherwise) if a User assumes that an order was not placed because they failed to receive confirmation.

Any ticket-holder unable to present confirmation of purchase in the form of a print out of the email (or web-page equivalent) and valid identification indicating they are the individual named on the confirmation may not be admitted to an event, delivered the products or any other service paid for on the platform in question, and will not receive a refund.

Tickets can be issued in the form of E-tickets and sent to the Users either via email or via the notification on the Platform or on application.

 

8. EXCHANGES AND REFUNDS

8.1 The varying exchange and refund policies set forth by our Users prohibit Eventbuz from issuing exchanges or refunds after a booking is placed. If a refund or exchange is requested by a User, the latter is advised to contact the selling party directly to process their request as per the selling user’s own exchange and refund policy. If an Organizer is selling ticket via direct phone call to the Users or via diverted URL, Eventbuz is not responsible of any refund.

Eventbuz does not permit exchanges for tickets or products or to events staged by different Organizers or products sold or services rendered by other Users.

If the organizer is selling ticket via direct phone call to the organizer or via diverted URL, Eventbuz is not responsible of any refund.

 

8.2 Cancelling an Event

If an Event is cancelled by the Organizer (i.e. a cancellation due to circumstances beyond Eventbuz’s control), Eventbuz will refund the purchase price of a Users’ tickets including the booking fee, (but excluding any delivery charge, refund protection or telephone service fee); whether that fee was originally presented as a separate item or was included within the stated face value of the ticket. Donations and Sundry Items will also be refunded in full. 

Where Eventbuz has been notified by the Organizer of an Event cancellation, we will use best endeavors to contact Users by email (using the details provided at the time of booking) advising them of the cancellation and initiating the refund process.

  • Eventbuz is normally notified in advance of any pending Event cancellation by the Organizer. We then automatically initiate refunds to all tickets purchasers. Customers can also notify Eventbuz directly if they discover than an event has been cancelled by emailing support@eventbuz.com

 

8.3 Event Postponed or Change of Venue

If an Event is moved from its advertised venue and / or the date is changed, tickets already purchased may remain valid should the Users wish to attend the revised Event. If not, Eventbuz will refund the purchase price of a Customer's tickets including our booking fee, (but excluding any delivery charge, refund protection or telephone service fees); whether that fee was originally presented as a separate item or was included within the stated face value of the ticket. Users must contact Eventbuz no later than the Monday following the event's revised date.

 

8.4 Significant Change to Event Line-up

Should the headline artist not appear or if the line up or content is substantially changed from that advertised at the time of purchase, then Eventbuz will on request refund the purchase price of a Users’ tickets including our booking fee, (but excluding any delivery charge, refund protection or telephone service fees); whether that fee was originally presented as a separate item or was included within the stated face value of the ticket. Users must contact us as soon as possible and no later than the Monday following the event's stated date.

 

8.5 Refunds requested after the Transfer of Funds

Users are required to contact Eventbuz no later than the Monday following the event to request refunds due to a postponed event, change of venue or significant change to event or line-up. Refunds can then be processed prior to the transfer of ticket income to the Event Organizer. Eventbuz will not be able to process refunds after the Monday following the event unless the refund is due to an event cancellation that we have retained funds to cover all ticket refunds.

If Users request refunds of their tickets after ticket income has been transferred to the Organizer, the responsibility for the refund will lie with the Organizer and all enquiries will be directed to the Organizer. Eventbuz will not be liable for any refunds once the process to transfer ticket income to the Organizer has commenced.

 

9. REFERRAL SCHEME

The referral scheme provides a cash incentive to Users to introduce new users to Eventbuz via promo code provided to the User. Every User will be provided with a unique promo code to identify the referral and the referred User.

 Eventbuz will pay the introducing User 10% of every booking fee net of any VAT we earn from introduced users. If a ticket is refunded or an event is cancelled, no referral payment will be applicable. The referral payment will be made to the Event Organizer on a quarterly basis for amounts over.  

User cannot self-refer (i.e. refer a new Eventbuz account where the new account is within the same local organization or the introducing Event Organizer has an active involvement in the newly signed up organization). Eventbuz reserves the right to cancel a referral if self-referral is suspected.

If a new sign-up fails to add the referral link during the registration process, Eventbuz can apply the referral up to seven days from the account being created providing an introduction can be evidenced.

 

10. CUSTOMER DATA

10.1 In respect of any personal data as defined in the General Data Protection Regulations (Regulation (EU) 2016/679), also known as GDPR, the Users hold responsibility to ensure that they comply with the Regulations and continue to comply with any future amendments to the Regulations and any guidance notes or guidelines issues by the Information Commission.

Subject to all applicable data protection legislation and the terms of our Privacy Policy, all Users personal data generated in connection to the events or activities on the platform shall be owned by the Users (as the Data Controller) and, subject to any relevant consents being granted by the Users under GDPR, shall be entitled to use such data in whatever manner they see fit. Eventbuz, as the Data Processor, is permitted by Users such as Organizers or Suppliers or Places to access a User’s Personal Data to be able to deliver the Service as outlined in these Terms and Conditions of Use. 

 

10.2 Eventbuz is dedicated to providing a high quality and secure service to its Users. We are fully PCI DSS compliant and adhere to the General Data Protection Regulations as a Data Processor (for processing products-buying customer's data) and as a Data Controller (for processing Event Organizer’s data). Eventbuz is committed to only using highly secured servers for the data and for the technical platform to ensure the highest standards of data protection.

 

11. BARCODE SCANNERS, TICKET STOCK AND TICKETS PRINTERS

11.1 Generally, and for the event admission feature specifically, Eventbuz infrastructure is based on using mobile phones as barcode and QR code scanners to scan barcodes and QR codes. Organizers must use mobile devices, which have barcodes and QR codes scanning ability to admit tickets’ holders to the Event. Eventbuz do not and will not provide any devices for Organizers and Events to serve as barcodes and QR codes scanners. It is within the Organizers responsibility to ensure that devices used as scanners are suitable to be used. Eventbuz is not and will not be responsible for any deficiencies and/or for the malfunctioning and/or the misuse of the devices provided by the Organizers.

 

11.2 Eventbuz will not provide or produce any stock of tickets for any Event and/or for any Organizer. All tickets issued by the Platform are E-tickets sent by email and on the Platform.

 

11.3 Eventbuz will not provide any ticket printers for any Event or Organizer. In case Organizer wants to print ticket, Organizer should provide suitable printers and all necessary accessories and materials required to print the tickets.

 

12. DISCLAIMER

 

12.1 The Platform and its content are delivered on an "as-is" and "as-available" basis. Eventbuz disclaims all warranties, express or implied, including also any implied warranties of merchantability and fitness for a particular purpose.

 

12.2 Eventbuz does not promise that the Platform will be error-free, uninterrupted, or that it will provide specific results from use of the site or any content, search or link on it.

 

12.3 Eventbuz cannot ensure that files you download from the Platform will be free of viruses or contamination or destructive features.

 

12.4 Eventbuz will not be liable for any damages of any kind arising from the use of this Platform, including without limitation, direct, indirect, incidental and punitive and consequential damage. Eventbuz makes no guarantee of any specific result from use of this Platform or use of Eventbuz service.

 

12.5 We maintain other terms and policies that supplement the Terms like our Customer Purchase Policy, Privacy Policy and our Customer Commitment.

 

12.6 These Terms are a binding legal agreement between you and Eventbuz that govern your right to use the websites, applications, and other offerings from Eventbuz.

 

12.7 "A User’s reservation/booking/purchasing is also bound by the terms and conditions of the Businesses. 

If you do not fully agree to these Terms and any other terms and conditions posted or linked to the Platform, you are not authorized to access or otherwise use the Platform.).

If there are any conflicts between the terms and conditions of the Platform and the terms and conditions of the Businesses, the terms and conditions of the Businesses where the reservation/booking/purchasing is finalized will prevail.

 

12.8 You are not authorized to use the Platform unless you are at least 18 years of age and able to enter into legally binding contracts. We do not knowingly collect the information of individual under the age of 18. If you arrived on this Platform after having been re-directed or otherwise clicking on another page/website/advertisement, you agree that these Terms shall govern your use of this Platform."

 

13. LIMITATION OF LIABILITY

13.1 Whilst we endeavor to ensure that the Platform is fully operational at all times, on those occasions when there are interruptions to service due to essential maintenance, system upgrades, internet service interruptions or any other factors beyond our control, Eventbuz will not be liable for any indirect, consequential, exemplary, incidental, special or punitive damages, or for lost profits, revenues or business opportunities, even if Eventbuz has been advised of the possibility of such damages.

In no event shall Eventbuz be liable for any indirect or consequential loss or any loss (whether incurred directly or indirectly) of profit, business, revenue, date, goodwill or reputation.

Eventbuz disclaims any and all liability for the acts, omissions and conduct of any third party users, Eventbuz Users, advertisers and / or sponsors on the platform, in connection with Eventbuz service or otherwise related to your use of the platform and /or Eventbuz service. Eventbuz is not responsible for the products, services, actions or failure to act of any venue, performer, promoter or other third party in connection with or reference on the platform.

 

14. INDEMNITY

14.1 You shall indemnify Eventbuz, defend and hold harmless Eventbuz and Eventbuz’s affiliated or related companies and their respective joint ventures, successors, assigns, directors, officers, employees and agents and shall keep each of them fully and effectively indemnified against any and all losses, imposed on, incurred by or asserted against them arising from:

  1. any breach of the Terms or breach of warranty by the Users of the acts or omissions of the Users, your employees, sub-contractors or agents;
  2. any Event or Venue (other than and to the extent that any losses arise directly from breach of those Terms by Eventbuz or our negligence);
  3. any breach of copyright or privacy laws or any other applicable law;
  4. any advertisement, marketing or promotion (other than any material produced by Eventbuz), including without limitation the production and placement of fly-posters.

 

15. TRADEMARKS

Eventbuz the Platform: the website, the mobile application, and design are registered trademarks.

1. WHO YOU ARE BUYING FROM?

Eventbuz provides the technical platform and the transactional infrastructure by which Event Organizers make their tickets available for purchase online by you, the Customer.

Eventbuz merely facilitates the transaction between Event Organizers and Customers. We do not set ticket prices or determine availability or location of seating. We simply handle the booking process and collection of payments on behalf of Event Organizers when you purchase tickets online.

 

2. EVENT INFORMATION

All details of Events including, but not limited to, performance times, venue, ticket prices and seat availability are entered onto the Eventbuz website by the Event Organizer. The accuracy of all such information is at all times the responsibility of the Event Organizer.

 

3. TICKET SALES PROCESS

You can search the Eventbuz site by event name, price, type, location, distance from location and/or date to navigate to the specific event in which you are interested. You may then specify:

a) the venue section or price category in which they wish to buy seats;

b) the quantity of seats they wish to buy;

c) where relevant, the position of those seats.

The site will then display the payment due for the seats specified which will include any booking fees or delivery fees (if applicable). You will then be asked to select your preferred method of Payment and having entered and submitted credit or debit card details, the Eventbuz system will charge the card issuer the appropriate amount. On completion of the transaction, the chosen seats will be registered in your name and you will be sent confirmation of booking via email and on application notifications.

We recommend that when using the site, you ensure that you are only using one browser window. Using multiple browser windows could result in you losing your ticket selection, duplicate charges or timer expiration. When making payment, you must not use the "back" button on your browser as this may cause you to lose your ticket selection or result in a duplicate booking.

 

4. CURRENCY

Payment for tickets sold through Eventbuz are in the currency shown on the event details. If purchaser wishes to pay in different currency, the integrated payment gateway can convert from the selling currency to the currency of choice based on the purchase date conversion rate. It is purchaser responsibility to verify, confirm and approve the converted fee prior proceeding with the payment.

 

5. ORDER CONFIRMATION

Order confirmation will take the form of a summary web page at the end of the purchase sequence. This will be followed by a booking confirmation email dispatched to you. Both contain details of the seats purchased and a unique purchase reference number, which acts as your proof of payment and may be used by the Event Organizer as an e-ticket.

If you do not receive a confirmation number (in the form of a confirmation page or email) after submitting payment information, it is your responsibility to confirm with our Customer Service Department whether or not the order has been completed, as only you may be aware of any problems that may occur during the purchase process. Eventbuz will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation.

Any ticket-holder unable to present confirmation of purchase in the form of a print out of the email (or web page equivalent) and valid identification indicating they are the individuals named on the confirmation may not be admitted to the event, and will not receive a refund.

 

6. DISPATCH OF TICKETS

Tickets will be issued in two different formats:

  • Etickets (emailed to you immediately following the successful purchase of tickets and that you will need to print and present at the venue);
  • Tickets by text (a unique booking reference and barcode will be sent to your mobile phone which must be presented at the venue);


It is the purchaser’s responsibility to ensure that correct ticket delivery information is provided (email address, mobile number or postal address) as incorrect information will result in tickets not being successfully delivered. Eventbuz will not be held liable for ticket refunds, ticket exchanges or any other costs arising as a result of incorrect information provided by the customer.

If tickets are not received immediately following completion of the booking (e-tickets or mobile tickets) or within five working days (postal tickets) the purchaser must contact Eventbuz on support@eventbuz.com, or via contact us form available on www.eventbuz.com, prior to the event to enable us to update the contact information and re-send tickets. Additional charges may apply to re-send postal tickets.
Charges may apply to the dispatch of some tickets (mobile phone and standard post). Charges will be listed through the purchasing process.  Ticket delivery fees are non-refundable.

 

7.  EXCHANGES
Before placing a booking, carefully review your event and ticket selection. Once purchased tickets cannot be exchanged.

The varying exchange and refund policies set forth by Event Organizers prohibit Eventbuz from initiating exchanges or refunds after a booking is placed or if a ticket is lost or stolen. In the event of such reversal of transaction being desired, you should contact the Event Organizer directly, as they may, at their discretion, agree to your wishes.

Booking fees whether originally presented as a separate item or included within the stated face value of the ticket are non-refundable unless an event is cancelled or significantly changes (please see point 9).

 

9. CANCELLED AND POSTPONED EVENTS

It is the responsibility of the Event Organizer to notify you if an event is postponed or cancelled and Eventbuz provides Event Organizer’s with the ability to send an email to all ticket-holders.  It is the ticket-holder’s responsibility to ensure that a correct email address is provided to receive event update messages.

Event Organizer should update the Event information on the platform (website and application) to notify ticket purchasers of the changes in the event (date, place, etc..)

It is your responsibility to check whether the Event is going ahead at the scheduled date, time and venue, and Eventbuz cannot guarantee that they will inform you of any changes to the event date, time or venue. You must notify Eventbuz of an event cancellation no later than the Monday following the event date. 

Eventbuz will under no circumstances be responsible for any remedy for inconvenience, consequential expenses incurred or any other loss or damages resulting from the cancellation or postponement of any Event.

If an Event is cancelled by the Event Organizer (i.e. a cancellation due to circumstances beyond the Event Organizer’s control), Eventbuz will refund the purchase price of your tickets and any booking fees. Ticket delivery, refund protection and telephone service fees are non-refundable.

Event Specific Refund and Exchange Terms and Conditions

Should the Event’s Organizer have event specific terms and conditions for a specific Event; these terms and conditions should be uploaded to the event profile ticket section. Purchaser should agree on these terms and conditions prior completing the purchase of tickets. These terms and conditions provided by the Event Organizer will be sent to purchaser as an attachment to the e-ticket sent by Eventbuz.
For any discretionary refunds (outside of event cancelation/postponement /significant change to event line-up as stated above) or exchange requests, please contact the Event Organizer who may be able to assist you, subject to their own discretionary refund or exchange policy. Any such refunds will be less the booking fee.

 

10. DONATIONS AND GIFT AID

Some Event Organizers will provide an option to make a financial donation as part of the booking process. You are under no obligation to make a donation. Should you add a donation to your booking, Eventbuz will forward your donation to the Event Organizer less a 7.5% administration fee.

If a donation request is stated to be valid for Gift Aid, you confirm that you are a taxpayer in accordance with the requirements of the Gift Aid Scheme. If you choose to make a Gift Aid donation, your personal information may be used by the relevant Event Organizer so they can reclaim your Gift Aid amount.

Should an event be cancelled and you booked via Eventbuz, the donation will be refunded back to your card, Eventbuz is not an accounting, taxation or financial adviser, and you should not rely on information given on the Platform to determine the accounting, tax or financial consequences of making a donation to charity. We strongly recommend that you consult your own adviser(s) about any accounting, taxation or financial consequences that may affect you.

 

11. UNLAWFUL RESALE OF TICKETS

The unlawful resale (or attempted unlawful resale) of a ticket is grounds for seizure or cancellation of that ticket without refund or other compensation.

 

12. TERMS AND CONDITIONS OF THE EVENT ORGANISER

The tickets are issued subject to the terms and conditions of the Event Organizer if added to the Event’s profile. Otherwise, Eventbuz terms and conditions apply. Regarding the refund policies related to Event cancelation, Event change of date, complaints, and/or change in line-up Eventbuz terms and conditions apply.

If applicable, the details of an Event Organizer’s terms and conditions will be available through the purchasing process or at the venue box office. Breach of any of these terms and conditions or any unacceptable behavior likely to cause damage, nuisance or injury shall entitle the Event Organizer to eject you from the venue.

It is your responsibility to comply with any age restrictions, which apply to the Event or the venue where the event is being held.

 

13. QUERIES AND COMPLAINTS

  • As Eventbuz is the technical Platform, any disputes or complaints regarding an event or ticketing should be directed to the Event Organizer.  You can contact the Event Organizer using the contact details shown on the Organizer’s Profile via the Eventbuz website.  If your complaint is due to an event cancellation, change of date, change of venue or change of named headline act (concerts only) please refer to Section 9 above.   If you have a query or complaint regarding Eventbuz, please send your comments by email to support@eventbuz.com where we will try to resolve your query or investigate our complaints procedure on your behalf. 

If we are unable to settle any dispute by negotiation and you are not satisfied with our final response, these Terms will be interpreted in accordance with Jersey laws.  The competent Jurisdiction should be the Jersey courts.
